IF I AM DENIED, DO I PAY LEGAL BILLS?

Don't be afraid to get representation for your Social Security disability claim. If you don't win your case, you will not have to pay any legal fees or expenses. Furthermore, if you don't get awarded back pay you won't have to pay any fees or expenses. This is called a "contingency fee arrangement," where you pay your representative only out of any back pay awarded to you.

So, what happens if you do win and get back payments? Social Security will withhold the agreed upon fee out of your back pay settlement and pay the representative directly. The approved fee is an amount that you and your representative have agreed upon in writing. This fee must also be approved by the judge who awarded your benefits.
