VETERANS MAY BE APPROVED QUICKLY
The Social Security Administration gives disabled veterans with a 100 percent VA rating a way to have their SSDI claim settled much more quickly than the average claimant. Veterans with this 100% VA disability rating are entitled to expedited processing.
While a typical SSDI claim drags on for months or years, a "Wounded Warrior" may be approved in as little as about three and one-half months, and sometimes more quickly. Some things to keep in mind:
--Veterans have the burden to file an SSDI claim and provide proof of their medical disability, independent of the VA determination. (Social Security won't just accept the VA decision alone).
-- Veterans may get 100% Social Security disability plus 100% VA disability at the same time. The two don't offset or reduce each other.
-- Social Security benefits, in some cases, can begin even before military discharge and even while the service member is receiving full active military pay. The requirement is that the service member is unable to perform his military duties.
The Forsythe Firm is experienced in representing disabled veterans before the Social Security Administration. They often are required to appear before an Administrative Law Judge for a hearing. This is because the state agency that makes the initial decision frequently denies the claim in error and it takes a judge to reverse the error and award the benefits.
